2. The petitioner seeks regular bail in connection with Warisnagar P.S. Case No. 111 of 2023, registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
3. As per prosecution, petitioner and other co-accused were arrested while they were planning to commit dacoity. One pistol and 4 live cartridges were recovered from the petitioner. Learned counsel for the petitioner submits that the petitioner is in custody since 07.04.2023.
4. Learned APP has vehemently opposed the prayer for bail.
5. Considering the nature of allegation and period of
Patna High Court CR. MISC. No.39574 of 2023(2) dt.21-07-2023 2/2 custody, this application is allowed.
6. Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1, Samastipur in connection with Warisnagar P.S. Case No. 111 of 2023.
7. This is also subject to the conditions that the petitioner shall mark his presence in Warisnagar Police Station, District- Samastipur on first Sunday of every month, failing which, his bail bonds shall be cancelled by the court below. (Sandeep Kumar, J) Ranjeet/- U T
