The petitioners seek bail in a case registered under Sections 147, 148, 149, 448, 341, 323, 338, 379, 307, 332, 333, 435, 325, 326, 335, 426, 427, 434, 440 of the Indian Penal Code and 27 of Arms Act.

Prosecution case, in short, is that F.I.R. named accused persons and near about 400 to 500 persons attacked on the police station in protest of an accident, in which four persons sustained injuries and in course of that protest, they assaulted the police officials with different weapons and also set one bus

It has been submitted on behalf of the petitioners that the petitioners are in custody since 4.4.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. 31 persons are named in the F.I.R. along with 400 to 500 persons. General and omnibus allegation has been made. No specific overt act has been alleged against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Rupauli P.S. case No.112 of 2014.
