Petitioner already in custody in connection with Sessions Trial No.460 of 2016, arising out of Sadar P.S. Case No.300 of 2016 is an accused in a case registered under Sections 302, 201 and 120(B) of the Indian Penal Code. Allegation in brief is that the petitioner went somewhere else along with the deceased and thereafter his dead body was found.

It is submitted that except that they went together, there is no material against the petitioner and the post-mortem report shows only one abrasion on the forehead, which is the cause of the death and that is accidental in nature.

Raja be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional District & Sessions Judge, Purnea in connection with Sessions Trial No.460 of 2016, arising out of Sadar P.S. Case No.300 of 2016.
