JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Naubatpur P.S. Case No. 171 of 2016, registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court Additional Chief Judicial Magistrate-II, Danapur. The accusation is of killing the daughter of informant and her minor daughter by her husband and in-laws due to nonfulfillment of demand of dowry and also to dispose of the dead body.
Learned counsel for the petitioner submits, in fact, daughter of informant, who was the wife of the petitioner and her minor daughter sustained burn injury in her bedroom and on
Patna High Court Cr.Misc. No.3946 of 2017 (4) dt.23-03-2017 alarm, both were taken outside from the bedroom and rushed for hospital but both were declared dead on the gate of Apollo Hospital and thereafter, the dead body were disposed of. Further submission is that petitioner is in custody since 24.04.2016 and the charge sheet has already been submitted.
Admittedly, daughter of informant and her minor daughter died within seven years of marriage at her matrimonial house.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for grant of bail stands rejected.
