JUSTICE SANJAY KUMAR ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.

The petitioner seeks regular bail in connection with Raghopur P.S. Case No. 183 of 2016 registered for the offences punishable under Sections 413, 414/34 of the Indian Penal Code.

The S.H.O. of Raghopur Police Station in course of motor-cycle checking, apprehended two motor-cycles. The petitioner was in possession of one motorcycle who did not produce any paper to show the ownership of the said motorcycle in question.

Learned counsel for the petitioner submits that one Om Prakash Kumar has been allowed bail by the court below as

Patna High Court Cr.Misc. No.6004 of 2017 (2) dt.22-02-2017 2/2 the owner of the vehicle by filing a petition stated that the said motor-cycle was handed over to the co-accused. The petitioner neither claims the said motor-cycle nor any person has come forward to claim the motor-cycle in question. The petitioner was arrested merely on suspicion and he is in custody since 30.09.2016, having no criminal antecedent.

Learned APP for the State opposed the submission. Considering the nature of allegation, facts and circumstances stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur, District- Supaul in connection with Raghopur P.S.
