The petitioner seeks bail in anticipation of his arrest in connection with Sono P.S. Case No. 08 of 2020, dated 11.01.2020, instituted for the offences under Sections 341, 353, 323, 422 and 379 of the Indian Penal Code. It has been alleged in the F.I.R. that the petitioner managed to escape even though he was arrested in

Patna High Court CR. MISC. No.36057 of 2020(2) dt.05-04-2021 2/3 connection with Sono P.S. Case No. 06 of 2020. This was done by the petitioner by giving a push to the informant. The learned counsel for the petitioner has submitted that in the aforesaid Sono P.S. Case No. 06 of 2020, the petitioner has not been made accused but only later, his participation had surfaced. The two other accused persons of this case had been arrested in connection with Sono P.S. Case No. 06 of 2020 and there was some discussion between them and the petitioner with the informant and because of that, the present case has been lodged against the petitioner also.

The petitioner has been granted bail in the aforesaid Sono P.S. Case No. 06 of 2020.

Apart from the present case as also the case about which the reference has been made earlier (Sono P.S. Case No. 06 of 2020), there is no other case against the petitioner.

Regard being had to the nature of accusation against the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of

No.36057 of 2020(2) dt.05-04-2021 3/3 eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Jamui in connection with Sono P.S. Case No. 08 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
