The allegation is of beating up the deceased as also throwing him down on the ground as a result of which he died. The deceased as per the allegation had gone to realize his wages from the accused persons.
Submission is that the deceased died of over drinking. It was contended in that connection that the deceased was drunk, has been admitted in the First Information Report itself and that he was never beaten up is signified by the fact that neither any external or internal injury was found by the doctor who held post-mortem examination. In the opinion of the doctor, the lungs and other organs of the body appeared normal.
Regard being had to the above facts which had been

No.18515 of 2015 (3) dt.30-07-2015 2 / 2 recorded by the learned Sessions Judge, Munger in his order, let petitioner Ram Mandal be directed to be released on bail either in the event of his arrest by the police or surrender in the court below on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger in connection with Kharagpur P.S. Case No. 290 of 2014, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
