The petitioner seeks bail in anticipation of his arrest in connection with Samastipur Town P.S. Case No. 267 of 2019 instituted for the offences under Sections 307, 323, 341, 504 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Vide order dated 05.04.2021, this Court had called for the case-diary and had granted provisional anticipatory bail to the petitioner.

The petitioner is alleged to have taken part in

No.36010 of 2020(3) dt.21-05-2021 2/2 the assault but according to the accusation in the F.I.R., the firing resorted by one of the co-accused persons, namely, Abhishek Gupta, is only said to have hit the informant. The learned counsel for the petitioner has submitted that there is only one injury on the person of the informant and all the witnesses in the police papers have only supported the accusation against Abhishek Gupta of having caused hurt to the informant.

The petitioner has clean antecedents.

Considering the afore-stated facts, the provisional anticipatory bail granted to the petitioner is, hereby, confirmed. The petitioner shall remain on the same bail-bonds.
