The petitioner, already in custody, seeks bail in connection with Dawath P.S.Case No. 46 of 2015 registered under Sections 120B of the Indian Penal Code.
Allegation in brief is that the loan given to the members was not recovered and due to the financial mismanagement and giving more commission to the agents by the petitioner and also indulged in miscellaneous expenditure caused loss to the tune of Rs. 56,97,658.80 approximately of the investors.
Submission is that the petitioner is an Assistant Manager in the PACS and according to the rules of the PACS Sanchalan Margdarshika, the entire responsibility of the PACS is
Patna High Court Cr.Misc. No.5607 of 2017 (3) dt.09-03-2017 2/2 upon the Chairman and the petitioner is an employee appointed in the PACS and there is no specific allegation of defaulcation of money by this petitioner.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Vinod Dubey, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bikramganj in connection with Dawath P.S.
