NILU AGRAWAL ORAL ORDER 13-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 06.04.2016 in connection with Sessions Trial No. 418 of 2016/ 320 of 2016, arising out of Nawada Nagar P.S. Case No. 199 of 2016 pending in the Court of learned Additional District and Sessions Judge-II, Nawada registered for the offence punishable under Section 302 of the Indian Penal Code.
The prosecution case is that the brother of the informant was brutally done to death by the petitioner, who was a vegetable seller, as he got to know from one Pappu Singh. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in the
Patna High Court Cr.Misc. No.5866 of 2017 (3) dt.13-04-2017 2/2 aforesaid case.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances and having gone through the case diary, I am not inclined to grant privilege of bail to the petitioner.
This application is, accordingly, rejected.
