The petitioner seeks bail in connection with Bihar P.S. Case No. 129 of 2020, dated 25.02.2020, instituted for the offences under Sections 341, 342, 323, 307, 326, 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Patna High Court CR. MISC. No.35745 of 2020(3) dt.05-03-2021 2/3 The petitioner is in custody since 03.03.2020. Mr. Thakur, learned Advocate for the petitioner has informed this Court that there has not been any progress in the trial before Court below so far as this case is concerned. It has been submitted on behalf of the petitioner though the petitioner has been named in the F.I.R., but the allegation of killing the deceased is on somebody else. The occurrence appears to have taken place in a cricket field where the parties had gone to play cricket. That apart, except for naming the petitioner in the F.I.R., no specific accusation has been levelled against him.

Some of the other accused persons of this case are stated to have been granted bail by different Benches of this Court.

Regard being had to the nature of accusation and the period of custody of the petitioner as also that there has not been any substantial progress in the trial, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
