The Court has shared its mind with the learned counsel for the petitioner and had pointed out that in case the petitioner was ready to pay back the amount of money which is alleged as the damage which was incurred by the electric supply company then the Court will be issuing a direction to the court below for admitting the petitioner to bail. The learned counsel for the petitioner has readily agreed.

Let the petitioner surrender and file a petition under the appropriate provision of the Indian Electricity Act seeking the compounding of the offence with the Bihar Electricity Board or its subsidiary company in connection with Sasaram (M) P.S. Case No. 1016 of 2014. The copy of the compounding petition shall be made over to the counsel and the

No.17180 of 2015 (3) dt.23-07-2015 2 / 2 petitioner shall be admitted to provisional bail under the condition that he shall be paying up the amount of Rs. 66,224/- to the Bihar Electricity Board of Sasaram Rural Division. The court shall be advising the learned Chief Judicial Magistrate, Sasaram to consider the prayer of the petitioner if it is made before him to allow the petitioner to pay the amount in four installments of equal or almost equal amount. The contention was that the petitioner has also paid about Rs. 20,000/- to the electric supply company or the Board. If the receipt in that behalf is produced and the same is acknowledged by the counsel for the Electricity Board, that amount shall be deducted and arrear amount shall be paid in installments four in number as directed above. As soon as the total amount is paid in four months, the provisional bond of the petitioner shall be confirmed by the court.

With the above directions, this petition stands disposed of.
