The Petitioner seeks bail in Sarai P.S. Case No.82 of 2016 instituted for the offence under Section(s) 399, 402, 414 Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. As per written report, one pistol on which made in USA was printed along with six cartridges were recovered from the possession of this petitioner.

It has been submitted that the petitioner has clean antecedents. Seargent Major has reported in para 89 of the case diary that country made pistol was recovered from the possession of the petitioner. Petitioner is in custody since 05.07.2016. Keeping in view the clean antecedents of the

Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 13th, Vaishali at Hajipur, in connection with Sarai P.S. Case No.82 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
