Petitioner seeks bail in connection with Kadirganj P.S. Case No. 75 of 2014 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.
Allegedly, Ramratan Bind, the son of the informant, was taken away by the accused persons and thereafter, he was killed behind the house of Yogi Bind.
Submission is of false implication and that there is no specific allegation, there are altogether 9 accused persons and who stabbed the son of the informant is not mentioned in the first information report nor it has come during investigation. Coaccused Mahesh Bind, Munaki Devi, and Ram Babu Bind have already been allowed bail and further Parmod and Subodh Bind have also been allowed bail and the petitioner is suffering in
Patna High Court Cr.Misc. No.4619 of 2017 (2) dt.07-03-2017 custody since 04.11.2015 having no criminal antecedent. Learned APP submits that the petitioner is also named in the FIR.
In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. K. Singh, J. M. Ist Class, Masaurhi at Patna in connection with Kadirganj P.S. Case No. 75 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
