JUSTICE JYOTI SARAN ORAL ORDER 16-08-2017 The petitioners who are 23 in number happen to be the Class IV employees working under the Patna Municipal Corporation. They pray for appropriate direction to the respondents including the Patna Municipal Commissioner to grant them the benefit of the first and second Assured Career Progression together with arrears of salary as due to them consequent upon the revision of their pay scale with effect from 1.1.2006 together with admissible interest. The matter was taken up on 26.7.2017 when on prayer made by Ms. Archana Palkar Khopde learned counsel for the Corporation, the matter was adjourned and when taken up today Ms. Khopde informs that she has not yet received instructions.
In the circumstances discussed and considering the nature of relief prayed instead of awaiting of a counter affidavit, I deem it proper to dispose of the writ petition with the direction to the Municipal Commissioner, Patna Municipal Corporation to
Patna High Court CWJC No.20165 of 2016 (3) dt.16-08-2017 3/3 consider the grievance of the petitioners as also reflected in the representation present at Annexure- 4 series and dispose of the same in accordance with law and after opportunity of hearing to the petitioners expeditiously and preferably within 3 months from the date of receipt/production of a copy of this order. The writ petition is disposed of.
