2. The petitioner seeks bail in connection with Pandarak P.S. Case No. 29 of 2024 instituted for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the allegation in the FIR, it is a case of recovery of one country made Katta from the possession of coaccused person, namely, Sajit Mahto.

4. Learned counsel for the petitioner submits that the petitioner is innocent, committed no offence and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. He next submits that the petitioner is in custody since 08.02.2024. He next submits that similarly situated co-accused person, namely, Sanjit Mahto has already been granted bail by this Court passed in Cr. Misc. No.

Patna High Court CR. MISC. No.50414 of 2024(3) dt.02-08-2024 2/2 30352 of 2024 vide order dated 24.04.2024.

5. Learned APP for the State opposes the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Barh, Patna in connection with Pandarak P.S. Case No. 29 of 2024.
