2. The petitioner has preferred this application for grant of anticipatory bail in connection with Excise P. S. Case No. 416 of 2025 registered for the offences punishable under Section 30(a), 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018 and Sections 41(1), 41(2) of the Bihar Prohibition and Excise Act, 2016..

3. Recovery of 240 litres of spirit has been made from an alto car which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has falsely been implicated in this case. He has no concern with the alleged recovery or with the place of occurrence. Nothing incriminating has been recovered from the conscious possession of the petitioner.

No.38643 of 2025(2) dt.27-06-2025 2/2 Petitioner is not named in the F.I.R. rather his name has transpired in present case on the basis of suspicion as owner of seized Alto car allegedly used for transportation of illicit liquor. He submits that proper process of search and sizure has not been followed in this case. He also submits that the vehicle from which alleged wine was recovered was already sold earlier to the Prince Kumar, however, no valid deed of sell has been prepared till date. He further submits that petitioner has got no criminal antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Keeping in view the aforesaid facts and considering the clean antecedent of the petitioner, let the petitioner, above named, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise - II, Aurangabad in connection with Excise P. S. Case No. 416 of 2025.
