JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 05-07-2017 I have heard the Counsels for the petitioner, the Bank and the State.
Petitioner is the widow of the employee. She was in receipt of family pension. By filing of the present application, she has prayed for a direction upon the respondents to issue additional quantum of pension to the tune of 30 % of the basic pension with dearness allowance thereon to her w.e.f. 30.05.2014 till the date of payment thereof. She was in receipt of quantum of pension available to the old family pensioner which now requires to be amended/enhanced. It is stated that the widow petitioner is aged about 88 years Counsel for the Bank states that the matter being old one, the
Patna High Court CWJC No.16352 of 2016 dt.05-07-2017 2/2 concerned authority will take a decision and issue a fresh sanction order whereafter the Bank will pay the dues of the petitioner as claimed in the writ petition.
Counsel for the State, on the other hand, submits that if a representation along with the copy of the order is filed in the office of the respondent Director General of Police, Government of Bihar, Patna , the claim of the petitioner shall be examined within 02 months on such filing.
Considering the above, the Counsel for the petitioner also agreed for disposal of the writ application.
Accordingly, in view of the agreement at Bar, the present writ application is disposed of. The petitioner shall file a representation along with a copy of the order in the office of the respondent Director General of Police and within 02 months thereafter, the said claim of the petitioner shall be examined and a fresh sanction order shall be issued whereafter the Accountant General shall issue the authority slip and the respondent Bank shall pay/credit the admissible dues in the pension account of the petitioner.
