The petitioner is accused in connection with Complaint Case No. 280 C 3 EX of 2016, registered under Section 3(a) of Excise Act.

The accusation is of recovery of 23 cartons, each containing 750 ML total 207 liters of India made foreign liquor from the house of the petitioner.

Learned counsel for the petitioner submits that the alleged recovery of India made foreign liquor has been made from joint house of the petitioner. The petitioner has no criminal antecedent is in custody since 17.12.2016.

Having regard to the facts and the circumstances of

Patna High Court Cr.Misc. No.6244 of 2017 (2) dt.07-03-2017 2/2 the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-VIIth, Nalanda at Biharsharif in connection with Complaint Case No. 280 C3 EX of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
