2. The petitioner seeks bail in connection with Jadia P.S. Case No. 26/2025 registered for the offences punishable under Sections 137(2), 96 of B.N.S. and later on Sections 64(1), 3(5) of B.N.S., Section 4/17 of the P.O.C.S.O. Act and Section 9/10 of Child Marriage Prohibition Act.
3. As per the prosecution case, petitioner is alleged to have kidnapped the informant's daughter.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Learned counsel further submits that from the statement of the
Patna High Court CR. MISC. No.39687 of 2025(6) dt.19-12-2025 2/2 victim girl, it appears that she had eloped with the petitioner and had got married to him. Learned counsel further submits that petitioner is a man with a clean antecedent and he is in custody since 29.03.2025. The petitioner undertakes to co-operate in the case/ trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Distt. And Addl. Sessions Judge-VI -cum- Spl. Judge Exclusive POCSO Court, Supaul/concerned Court below in connection with Jadia P.S. Case No. 26 of 2025.
