Having heard learned counsel for the parties, I am of the considered view that merely on account of nonappearance of the counsel on a particular date, the claim should not have been dismissed and the restoration application also rejected.

Keeping in view the aforesaid and in the interest of justice, the restoration application is allowed. The claim petition is restored to its original file. The Tribunal to proceed to decide the matter, in accordance with law.
