For the Appellant/s : Mr. Vivekanand Vivek, Adv For the Respondent/s : Mr. Kalyan Sharma, Adv Mr. Ashish Sinha, Adv ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 20-07-2017 Impugning the order dated 11.05.2016 passed by the Railway Claims Tribunal, Patna Bench in a claim case and dismissing the restoration application filed, this is an appeal under Section 23(1) of the Railway Claim Tribunal Act, 1987. Having heard learned counsel for the parties, I am of the considered view that merely on account of nonappearance of the counsel on a particular date, the claim should not have been dismissed and the restoration application also rejected.

Keeping in view the aforesaid and in the interest of justice, the restoration application is allowed. The claim petition is restored to its original file. The Tribunal to proceed to decide the matter, in accordance with law.
