====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 05-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Narpatganj P.S. Case No. 24 of 2017 instituted for the offence under Sections-363, 366A of the Indian Penal Code.

As per written report, the daughter of the informant aged about 15 years had been kidnapped by this petitioner with intention to marry her. The victim girl was recovered and her statement u/S 164 of the Cr.P.C. was recorded wherein she has stated that she had gone with this petitioner to Nepal and she returned when her parents went to bring her. From the statement of the victim recorded u/S 164 of the Cr.P.C., it appears that there was no force applied by this petitioner to take her to Nepal. The petitioner is said to be in custody since 19-01-2017.

No.20791 of 2017 (2) dt.05-05-2017 2/2 In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Narpatganj P.S. Case No. 24 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Araria subject to condition that both the bailors should be close relatives of the petitioner.
