Petitioner apprehends his arrest in a case under section 304B/34 I.P.C. and Section 3 and 4 of the D.P. Act. The informant made allegation of demand of dowry and torture against the petitioner and account of such, the petitioner, who is the husband, killed the deceased.
It is submitted that the mother-in-law and brother-inlaw have already been enlarged on anticipatory bail on consideration of the fact that the informant compromised the case.
Learned counsel appearing for the informant vehemently opposed the prayer of anticipatory bail. It appears that the petitioner is the husband and his wife died within 1.1/2 years of her marriage.
Considering the facts and nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly, the same is rejected.
Patna High Court Cr.Misc. No.41006 of 2014 (2) dt.02-04-2015 The petitioner is directed to surrender in the court below and pray for regular bail and the court below shall consider the prayer for grant of regular bail without being prejudiced from the order of this Court.
