JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 307 and other allies sections of the Indian Penal Code.

As per written application of the informant Hemant Kumar, the prosecution case in short is that on the alleged date of incidence, petitioner and others set the hut on fire in which one Majanu Mahato was living and demolished the boundary wall. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that due to land dispute the alleged offence is said to have taken place. It is further submitted that the land, in question, belongs to the petitioner and sale deed in respect to the land, in question, has

Patna High Court Cr.Misc. No.18047 of 2015 (4) dt.02-07-2015 2/2 also been brought on record.

On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in connection with Ahiyapur P.S.Case No. 167/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
