NILU AGRAWAL ORAL ORDER 15-03-2017 Heard learned counsels for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 18.06.2016 in a case registered for the offences punishable under Sections 304 (B)/ 34 of the Indian Penal Code. The prosecution case as lodged by the informant is that his daughter was married to one Amit Kumar Sah and for non payment of dowry, the petitioner, who is mother-in-law of the deceased along with the family members had killed his daughter. It has been submitted by the learned counsel for the petitioner that she is innocent and has falsely been implicated only on the ground of suspicion. It is further submitted that all the accused persons, except the husband have been granted the

Patna High Court Cr.Misc. No.6482 of 2017 (2) dt.15-03-2017 2/2 privilege of anticipatory bail by a Co-ordinate Bench of this Court and the petitioner is languishing in jail.

However, learned A. P. P. for the State submits that the petitioner is named in the F.I.R., hence, opposes the prayer for bail.

Considering the facts and circumstances and materials on record, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II, Siwan in connection with Sessions Trial No. 509 of 2016 arising out of Barhariya P. S. Case No. 252 of 2015, subject to the condition that the petitioner will appear before the Court as and when required and on failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
