The petitioner is apprehending his arrest in connection with Rampur Chauram P.S. Case No.01 of 2015 for allegedly having committed the offence under Section 414 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that the petitioner is a registered dealer of fertilizer and has unblemished record. Learned counsel further submits that the petitioner has nothing to do with the truck in question, which was seized along with bags of urea and the name of the petitioner has been brought in the present case for some oblique

Patna High Court Cr.Misc. No.19230 of 2015 (3) dt.02-09-2015 2/2 reasons. Learned counsel for the petitioner further submits that truck, bearing No.BR-01GB/8507, was never hired by the petitioner for transporting any material and the allegation as levelled is purely mischievous.

Considering the aforementioned facts and circumstances and also the fact that the petitioner has no antecedent of similar nature, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Deshmukh, learned I/C Sub-Divisional Judicial Magistrate, Jehanabad, in connection with Rampur Chauram P.S.
