JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-01-2024 Heard learned counsel for the petitioner and Mr. Md. Nadim Seraj, learned GP-5 assisted by Mr. Iqbal Asif Niazi, learned AC to GP-5 for the State. Mr. Kantesh Kumar Mishra, the Superintendent of Police, East Champaran at Motihari being available at Patna has appeared in person to address this Court.

This Court has been informed that the Superintendent of Police, East Champaran has already taken a decision to depute a bodyguard with the petitioner and it was duly communicated to the petitioner but the petitioner expressed his inability to provide accommodation to the bodyguard and requested the Superintendent of Police to provide him security from the police station level itself. The Superintendent of Police, East Champaran

Patna High Court CR. WJC No. 1203 of 2023(4) dt.18-01-2024 2/2 has assured this Court that he will depute the bodyguard with the petitioner from morning to evening hours and the patrolling party with the local police station shall take care of the rest of the period during the stay of the petitioner in his residential premises.

3. As regards the arrest of the accused persons, this Court has been informed that the accusation leveled against the accused are being investigated, certain materials have been collected but some more materials are being looked into and a view on the accusation of the accused persons would be taken very soon. After taking a view on the accusation based on the materials coming into course of investigation, necessary steps shall be taken to nab the accused persons and submit a police report in connection with this case in the court of learned Jurisdictional Magistrate.

4. To this Court, it appears that the Superintendent of Police, East Champaran is taking appropriate steps at this stage and no further direction need be issued save and except to say that whatever has been given to understand to this Court be given effect to within a reasonable period.
