JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-04-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner case seeks bail in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.

Allegation against the petitioner alongwith other accused persons is of killing the daughter of the informant due to non-fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no specific allegation against the petitioner. There is no eye witness in the present case. Charge-sheet has been submitted in this case. Petitioner is the husband of the deceased. He further submits that the police has investigated the case and in the case diary no independent witness has been examined in

Patna High Court CR. MISC. No.983 of 2021(3) dt.07-04-2021 2/2 the present case. All the family members of the deceased have been examined. The petitioner is in jail custody since 05.11.2019. The petitioner has no criminal antecedent which is mentioned in para 3 of the bail petition.

Learned APP for the State opposes the prayer for bail petition.

Considering the fact that the petitioner is husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Dehri Town P.S. Case No. 721/2019 from the Court of learned S.D.J.M., Dehri, District-Rohtas. Accordingly, this application is dismissed.

However, the trial court is directed to expedite the trial.
