Mr. Rajiv Nayan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-06-2026 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.
2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.
3. As per prosecution case, complainant placed an order for steel and iron worth Rs. 20,16,539/- out of which, Rs. 15,88,167/- was paid by the complainant to the accused persons. It is alleged despite receiving payment and repeated requests, the accused persons neither supplied the goods nor refunded the
Patna High Court CR. MISC. No.40302 of 2026(2) dt.29-06-2026 2/3 money and thus, dishonestly retained money of the complainant and caused wrongful monetary loss.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. The entire prosecution story, as alleged by the complainant, is false and concocted. No such order as alleged in the F.I.R. was ever placed by the complainant. As a matter of fact, petitioner is owner of Anand Mittal Ispat Pvt. Ltd. and there is absolutely no chit of paper on record in support of the alleged transaction. It is further submitted that the dispute is purely civil in nature and none of the acts allegedly committed by this petitioner would give rise to any criminal liability. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation and clean antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named

No.40302 of 2026(2) dt.29-06-2026 3/3 petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City in connection with Patna City Complaint Case No. 141 of 2022, subject to condition as laid down under Section 482(2) of the B.N.S.S..
