JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Rajapakar P.S. Case No.180 of 2014 registered for the offences punishable under Sections 341, 323, 324, 379, 308, 427, 447, 504, 506, 147, 148, 149, 435 of the Indian Penal Code and Sections 3 (i) (x) (xi) and 3 (2) (iv) of SC/ST (Prevention of Atrocities) Act. Allegedly, the petitioners and others stopped Pappu Kumar and Dharmendra Kumar and after using caste name assaulted with fat, slaps and bat causing injury to Pappu and Dharmendra and further torn their shirts and snatched Rs. 1500/-

Patna High Court Cr.Misc. No.19849 of 2015 (2) dt.09-07-2015 from the paint of Pappu Kumar.

Submission is of false implication and there is case and counter case. No injury has been caused to Pappu and Dharmendra and allegation for taking away Rs. 1500/- is not against the petitioners and as such the petitioners deserve sympathetic consideration to which the learned APP opposes. Considering the allegation attributed against the petitioners and noticing that it is a fit case for regular bail, the petitioners are directed to surrender before the court below and seek regular bail and in that event, they shall be enlarged on bail on execution of bail bonds to the satisfaction of the court below itself on the same day.
