The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, it is stated that on information having been received, a raid was conducted. While the accused persons managed to escape, amongst the accused the petitioner was identified by the Chowkidar. A total of 3453.865 litres of IMFL was recovered.

It is submitted by learned counsel for the petitioner that the petitioner was not arrested at the spot. No incriminating article has been recovered from his possession. He is in custody since 16.6.2021 and chargesheet has been submitted in the case. It is submitted that an affidavit has been filed online enclosing

Patna High Court CR. MISC. No.49214 of 2021(6) dt.25-04-2022 2/2 with the same copy of the receipt of deposit of cost of Rs.5000/ as directed by this Court.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 10 months and not having been arrest at the spot, the Court directs the petitioner to be enlarged on bail in connection with Paroo P.S. Case no. 231 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
