JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-03-2015 In view of the order dated 06.02.2015, the application of the petitioner no.3 has been disposed of, as during the pendency of this application he has been arrested.
Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners are accused in connection with Laxmipur (Gidhaur) P.S. Case No. 95 of 2014 registered under Sections 147, 149, 323, 324, 307 and 354 of the Indian Penal Code.
The Allegation against the petitioners is of causing assault to Gangiya Devi and Mithilesh Yadav, wife and son of the informant, Bhagirath Yadav, through bhujali, stick and by pelting
Patna High Court Cr.Misc. No.41681 of 2014 (3) dt.04-03-2015 2/2 stone.
Learned counsel appearing on behalf of the petitioners submits that admittedly, petitioners and informant are own brother and due to land dispute, occurrence took place in which Gangiya Devi and Mithilesh Yadav are said to sustain injuries but the injuries, as found on their persons, are simple in nature, which would appear from Annexure-2 series.
Considering the aforesaid submissions, let the above named petitioners, except petitioner no.3, be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Jamui in connection with Laxmipur P.S. Case No. 95 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
