The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 143, 323, 341, 324, 307 and 498A of the Indian Penal Code.

The accusation is of torture and assaulting the informant.

The marriage between the petitioner and the informant and birth of a female child are admitted facts. In pursuance to the notices issued vide order dated 29.04.2015 the petitioner and the informant are present. Petitioner is still ready to keep the informant and the child with

Patna High Court Cr.Misc. No.19627 of 2015 (03) dt.26-06-2015 2/2 dignity and honour, but the informant is not ready to accept the offer as she is apprehensive due to the past conduct of the petitioner.

It is submitted by learned counsel for the petitioner that the father of the petitioner transferred two and half katha of land after the marriage in favour of the informant. This fact is not being denied by the informant.

Considering the above facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 619 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
