JUSTICE RAMESH KUMAR DATTA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case under Sections 363,365 and 366(A) of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation of the informant was with regard to the kidnapping of his daughter by the father and brother of the petitioner. It is submitted that the trial of the father and brother, namely, Munni Lal Ram and Suresh Ram had been separated and they have been acquitted in Sessions Trial No. 445 of 2012 by judgment dated 28.5.2013 and the only allegation made against the petitioner is that she was also present at the time of marriage of the accused Suresh Ram with the victim girl.

No.35642 of 2014 (2) dt.20-02-2015 2/2 On a consideration of the facts and circumstances of the case, it is directed that the petitioner, Sarita Devi, in the event of her arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 91 of 2012 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur subject to other conditions laid down under Section 438(2) Cr.P.C.
