The petitioner is in custody since 14.02.2022 in connection with P.S. Case No. 642 of 2021 registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of Arms Act.

It has been submitted by learned counsel for the petitioner that there is no material against him to connect him with the crime except the suspicion that he is the brother of the deceased and because of property dispute he has killed the deceased.

The complete case diary was called for and the Investigation Officer of the case has produced the complete case

Patna High Court CR. MISC. No.42270 of 2022(5) dt.01-02-2023 2/2 diary and he submits that chargesheet has been submitted against the petitioner.

Considering the submission of the parties and considering the evidence sought to be introduced against the petitioner, this application for bail is allowed. In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with P.S. Case No. 642 of 2021.

The petitioner will co-operate in the trial.
