It is contended that though the petitioner has retired on 31.01.2002 as Medical Officer, Jamui Jail, his GPF amount, pension as well as three years' salary from 21.03.1969 to 06.11.1972 have not been paid when he was in Patna Secretariat posting.
Though, a counter affidavit has been filed on behalf of the respondent no. 10 that it is admitted position that GPF amount for that period has not been paid to the petitioner. Accordingly, this writ application is being disposed of with a direction to respondent no. 2, i.e., the Director in Chief, Health Services, Bihar, Patna to ensure payment of the admitted dues for the aforesaid period and if the salary is sanctioned and paid the respondent no. 10, i.e., the District Provident Fund Officer, Munger, Bihar would be required to take a decision as to whether the petitioner is entitled for payment of GPF for that period or not? If he is found entitled then the admitted dues along with statutory interest would be paid, however, if he is not entitled then respondent no. 2 would be required to pass a reasoned order and a copy of the same should be immediately communicated to the petitioner.
