Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307/506 and other allied sections of the Penal Code.

Prosecution case in short is that the informant's daughter Rekha Kumari was married with co-accused Jitendra Tiwari. Soon after the marriage, accused persons started to torture her and when the informant went to her matrimonial house for the Bidai of his daughter, all the accused persons assaulted him with iron rod as a result of which he sustained injuries.

Learned counsel for the petitioner submits that the petitioner is Dewar of the victim and there is no specific allegation against him. There is no allegation of tempering with

Patna High Court CR. MISC. No.35439 of 2019(2) dt.30-05-2019 2/2 the evidence against the petitioner. He furthers contends that there is a matrimonial dispute between the victim and her husband.

Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl Chief Judicial Magistrate IX, Saran at Chapra in Taraiya Police Station Case No. 86 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
