The prayer for bail of the petitioner was earlier rejected vide order dated 12.10.2020 passed in Cr. Misc. No. 21738 of 2020.

A report about the stage of the case was called for from the court below. The report indicates that out of 12 charge sheet witnesses 3 has already been examined. Taking into account the fact that the petitioner is in custody since 15.09.2019, this Court directs the trial court to positively conclude the trial within a period

Patna High Court CR. MISC. No.49412 of 2021(3) dt.08-12-2021 2/2 of six months from the date of receipt/production of a copy of this order.

If there is no substantial progress in the disposal of the trial within the aforesaid period, the petitioner would be at liberty to approach the trial court for grant of bail. In that event, the trial court would be required to state the reason for the tardy pace of the trial and non-conclusion of the same within the aforesaid period.

With the aforesaid direction/observation, the petition stands disposed off.
