The petitioners are accused in connection with Sour Bazar P.S. Case No. 151 of 2016, registered under Sections 147, 148, 149, 341, 323, 324, 302, 379, 504 and 506 of the Indian Penal Code.
The accusation is that 11 persons named in the F.I.R., including the petitioners, variously armed with weapon reached to the informant. At that time, Bipin Kumar gave 'Dabiya' blow on the head of Tetar Sah, father of the informant, and all looted the household articles of the informant. Later on, Tetar Sah, father of the informant, died in course of treatment.

No.3112 of 2017 (2) dt.07-02-2017 2/2 Learned counsel for the petitioners submits that while petitioners are named in the F.I.R. along with nine others, but specific allegation of causing injury through Dabiya blow is against Bipin Kumar. Further submission is that no overt act has been attributed against the petitioners. The petitioners have no criminal antecedent are in custody since 26.08.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S.
