The petitioners apprehend their arrest in connection with Paras Bigha P.S. Case No.121 of 2016 registered under Sections 304(B), 201, 120(B) of the Indian Penal Code. Allegation, in brief, is that the informant's daughter was married two years ago with the son of petitioner no.1 and due to non-fulfilment of Rs. one lakh and a motorcycle, she was killed by these petitioners and her dead body was disposed of secretly. The learned counsel appearing on behalf of the petitioners submits that the petitioner nos. 1 and 2 are the fatherin-law and mother-in-law and their daughter-in-law died due to illness, whereas the petitioner no.3 is the married 'nanad' of the deceased and she resides with her husband in her matrimonial home but falsely implicated in this case.
Considering the aforesaid facts and circumstances that the petitioner no.3- Minta Devi is married 'nanad' of the deceased and resides in her matrimonial home, let the petitioner no.3, Minta
Patna High Court Cr.Misc. No.5396 of 2017 (2) dt.06-02-2017 2/2 Devi, in the event of her arrest or surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount to the satisfaction of the learned J.M., 1st Class, Jehanabad in connection with Paras Bigha Case No. 121 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. So far petitioner nos. 1 and 2 are concerned, they are father-in-law and mother-in-law residing in the house and nothing is on record to show that their daughter-in-law was critically ill , moreover ultimately her dead body was disposed of secretly, therefore, their prayer for anticipatory bail is rejected. However, if the petitioner nos. 1 and 2, namely, Jugal Yadav and Reeta Devi surrender in the court below and pray for regular bail, then the same shall be considered and decided on its own merit without being prejudiced by this order.
