JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sahebpur Kamal P.S. Case No. 279 of 2014 registered for the offences punishable under Sections 363 and 365 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of minor son of the informant.

Submission of learned counsel for the petitioner is that neither in the FIR nor the materials collected during investigation disclosed any other incriminating materials against the petitioner except suspicion and he is ready to abide by any condition that may be imposed on him if anticipatory bail is granted to him.

No.36521 of 2019(4) dt.15-11-2019 2/2 In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S. Case No. 279 of 2014, G.R.No. 463C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in the investigation and if any incriminating materials has come against the petitioner, prosecution is at liberty to move for cancellation of bail bonds of the petitioner before the court below.
