The petitioner is accused in connection with Kathaiya P.S. Case No. 60 of 2016, registered under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. On the basis of the written report of the informant Mithilesh Kumar Mahto Kathaiya P.S. Case No. 60 of 2016, registered under Section 392 of the Indian Penal Code against unknown regarding robbery of motorcycle and mobile of the informant. In course of investigation, the petitioner was apprehended by the Police in connection with Kathaiya P.S. Case No. 67 of 2016 and Police got recorded his confessional statement showing the involvement of the petitioner
Patna High Court Cr.Misc. No.1138 of 2017 (2) dt.16-01-2017 2/2 in the present case, except that there is nothing against the petitioner to show his involvement in the present case. Further submission is that petitioner is in custody since 17.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kathaiya P.S. Case No.60 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
