The petitioner apprehends his arrest in connection with Barh P.S. Case No.543 of 2021, registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.
The petitioner is said to have stolen 50 pen drives from the office of the informant.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioner. It is submitted that police raided the house of the
Patna High Court CR. MISC. No.39498 of 2022(2) dt.17-11-2022 2/2 petitioner in his absence. There is no compliance of Section 100 Cr.P.C.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submitted that from perusal of the order impugned, it is clear that 50 pieces of pen drives of 32 GB have been recovered from the house of the petitioner.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
