JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 20-02-2015 Petitioner, who is a lady Acting Headmistress of a School, apprehends her arrest in connection with Sonbarsa P.S. Case No. 56 of 2005, instituted for offences under sections 409 and 420 of the Indian Penal Code.
Allegation in the F.I.R. is that on being directed by the Headmaster to hand over charge, she has not only denied to hand over the charge but forcibly captured and locked two rooms of the school.
Learned counsel for the petitioner submits that it is not certain that sections 409 and 420of the Indian Penal are applicable. In that view of the matter, in the event of arrest or surrender within a period of four weeks from today, the sole petitioner, namely, Kiran Devi is directed to be admitted to bail on
Patna High Court Cr.Misc. No.35273 of 2014 (2) dt.20-022/2 executing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sitamarhi, in connection with Sonbarsa P. S. Case No. 56/2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
