The petitioners seek bail in anticipation of their arrest in connection with Piprahi P.S. Case No. 144 of 2020 dated 21.07.2020 instituted for the offences under Sections 341, 323, 308, 354, 504, 379, 504, 506 and
Patna High Court CR. MISC. No.196 of 2021(2) dt.26-07-2021 2/3 34 of the Indian Penal Code.
The accusation in the FIR is of the petitioners assaulting the members of the prosecution party. Though some of the persons have been injured in the occurrence but all the injuries except one have been found to be simple in nature. One injury which has been found to be grievous is on the wrist of one of the victims.
In the counter case also there are injuries on the side of the petitioners.
Considering the fact that the parties are neighbours and agnates, they have expressed their desire before the court that they are not willing to prosecute each other. The petitioners no. 1, 2 and 3 are own brothers whereas petitioner no. 4 is the aunt of petitioners no. 1, 2 and 3. Petitioner no. 5 is the mother of petitioners no. 1, 2 and 3. The petitioner no. 6 is the sister of petitioner no. 4.
Regard being had to the aforestated facts, the
Patna High Court CR. MISC. No.196 of 2021(2) dt.26-07-2021 3/3 petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Sheohar in connection with Piprahi P.S. Case No. 144 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
