2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 304-B and 34 of the Indian Penal Code.
3. The case of the prosecution in short is that Komal Kumari (the deceased) was married two years ago with the petitioner. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand and it is further alleged that she was killed by her in-laws.
4. Learned counsel for the petitioner has submitted that from perusal of the post-mortem report it will transpire that no injury except the ligature mark was found on the person of the deceased. It is clear that the deceased had died in the
Patna High Court CR. MISC. No.38901 of 2025(3) dt.03-09-2025 2/2 matrimonial house but the evidence specifically the postmortem report does not show any injury on the person of the deceased. Learned counsel for the petitioner has also submitted that till today, trial has not still started. The petitioner is a man of clean antecedent and is in judicial custody since 27.06.2024.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Tarapur P.S. Case No. 242 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Munger.
