JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 11-07-2017 In the matter of loan taken by the appellant to the tune of Rs. 3,20,000/- for purchase of a tractor when the appellant did not repay the loan, recovery proceedings were initiated and when the recovery proceedings were challenged before the Writ Court, the learned Court disposed of the matter directing the appellant to deposit Rs. 1,70,000/- on or before 30th September, 2016 and thereafter to pay the loan in equal instalments, 30 in number, and on the same being complied with, the direction was that the tractor should not be auctioned.

Patna High Court LPA No.1941 of 2016 dt.11-07-2017 2/2 Keeping in view the nature of order passed by the Writ Court, we see no case made out for any indulgence into the matter. The Letters Patent Appeal stands dismissed.
