This application is for grant of bail in connection with Hilsa P.S.Case No.385 of 2016 for the offence under Sections 413, 414, 401, 467/34 of the Indian Penal Code and 25(1-B) a/26/35 of the Arms Act.
It is submitted on behalf of the petitioner that there is allegation of recovery of one country-made Pistol from the possessions of the petitioner and he is in custody for about six months. So far antecedent is concerned, it has been submitted that he is on bail in other cases also.
Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is criminal antecedent. Having heard both sides. From perusal of Para no.3 of the
Patna High Court Cr.Misc. No.5091 of 2017 (3) dt.16-02-2017 2/2 petitioner itself it appears that the petitioner is accused in three other cases also of similar nature and in this case, a country-made Revolver has been recovered from the possession of the petitioner. Had it been so, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court..
With the aforesaid observation, this application is dismissed.
