The petitioner seeks bail in Sigori P.S. Case No. 39 of 2019 (Special Case No. 3960 of 2019), instituted for the offence under Section(s) 272, 273 of Indian Penal Code and Section 30(a) of Bihar Prohibition & Excise Act, 2016. Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. From the seizure list it appears that recovery of country made liquor has been made from near Punpun river situated towards north side of Sanhara Ghat in village Sahora. Petitioner is in custody since 7.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.37691 of 2019(2) dt.21-06-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Sigori P.S. Case No. 39 of 2019 (Special Case No. 3960 of 2019), subject to the condition that both the bailors will be close relatives of the petitioner.
