2. In the present case, the petitioner seeks bail in connection with Harpur P.S. Case No. 100 of 2024 registered for the alleged offences under Sections 80, 3(5) of B.N.S., 2023.

3. As per prosecution case, the daughter of the informant was married with co-accused son of the petitioner and it was outcome of a love affair. The allegation against the petitioner is that she and other co-accused persons used to demand an Apache motorcycle and Rs.Five lakhs from the parents of the girl, and ultimately the daughter of the informant was done to death in her matrimonial home by hanging her.

4. Learned counsel for the petitioner submits that the

2/4 petitioner is innocent and has been falsely implicated in this case as she is mother-in-law of the deceased daughter of the informant. The allegation of demand of motorcycle and cash is not believable as the marriage was the result of love affair of coaccused son of the petitioner with the deceased daughter of the informant. The co-accused son of the petitioner eloped with the daughter of the informant and the marriage was opposed by the petitioner and others. But subsequently a compromise was made. Thus, the parties were on inimical terms. The deceased daughter of the informant committed suicide due to nonfulfillment of her desires. The petitioner always tried to settle the issue between the wife and the husband but they did not agree with her advice. The present case has been lodged due to non-fulfillment of illegal demand made by the informant. Learned counsel further submits that co-accused husband of the deceased is in custody. The petitioner is in custody since 03.04.2025. The petitioner is having clean antecedent and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner. Learned APP further submits that the petitioner and other family members have been specifically named by the informant who had been demanding an Apache

3/4 motorcycle and Rs.Five lakhs from the informant.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that the petitioner is mother-in-law of the deceased and there is general and omnibus allegation against her as well as other persons and further considering the submission of charge sheet and period of custody, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Munger/concerned Court in connection with Harpur P.S. Case No. 100 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the

4/4 petitioner will be liable to be cancelled by the court concerned.
